  • Ashcroft v. FSC

    What happened?

Child Porn Prevention Act is a federal that prohibits any type of child pornography, including virtual. Sexually explicitly images that appeared to depict minors, without using any children. Super broad act, so free speech coalition challenged the legality.

    Who won?

    FSC.

    Why did they win?

Affected the first amendment rights. No actual children were harmed during the making. The Government failed to give any good arguments.

How did the witnesses play a role (how did they go back and forth in their argument)? Important terms:

    1.       What’s the difference between "actual child pornography," "virtual child pornography," and "youthful adult pornography"? How are they relevant to free speech? Are they treated the same way, or differently? What are their implications for the computer profession?

      1. "actual child pornography," has a real life child in it
      2. "virtual child pornography," include computer-generated images, as well as images produced by more traditional means.
      3. "youthful adult pornography" are legal adults that look young and underage
      4. The only illegal one is actual CP, as set by Ashcroft v. FSC
